1. Agreement to Terms
By accessing or using dyBIdxAI.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and organizations ("Users") who access or use the Service.
2. Description of Service
dyBIdxAI.com provides an AI-powered interview platform that enables organizations to conduct automated candidate interviews with behavioral analysis and scoring. The Service includes video/audio recording during interviews, AI-generated evaluations, and reporting dashboards.
3. User Accounts
You must provide accurate and complete information when creating an account. You are responsible for safeguarding your account credentials and for all activities under your account.
Organizations are responsible for managing their members' access and ensuring compliance with these Terms by all users within their organization.
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
4. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful purpose or in violation of applicable employment laws
- Discriminate against candidates based on protected characteristics using the Service
- Attempt to reverse-engineer, decompile, or extract the AI scoring algorithms
- Upload malicious content, viruses, or code intended to disrupt the Service
- Share, resell, or sublicense your access without written permission
- Impersonate another person or organization
- Use automated tools (bots, scrapers) to access the Service beyond provided APIs
- Attempt to bypass rate limits, security measures, or access controls
5. Interview Data & Content
Organizations retain ownership of their interview data, templates, and candidate information. dyBIdxAI.com processes this data solely to provide the Service.
Candidates' interview recordings, transcripts, and behavioral data are processed for scoring purposes and made available to the hiring organization. Candidates should be informed by the organization that AI analysis will be performed on their interview.
We do not use your interview data to train our AI models without explicit consent.
6. AI-Generated Scores & Recommendations
AI-generated scores, hiring recommendations, and behavioral analyses are advisory tools. They should not be the sole basis for employment decisions. Organizations are responsible for making fair and lawful hiring decisions.
AI outputs may contain inaccuracies. dyBIdxAI.com does not guarantee the accuracy, completeness, or fairness of AI-generated evaluations.
7. BYOK (Bring Your Own Key) API Keys
If you provide your own AI provider API keys (Claude, OpenAI, Gemini), you are responsible for compliance with those providers' terms of service. Your API keys are encrypted at rest using AES-256-GCM. dyBIdxAI.com is not liable for charges incurred on your AI provider accounts.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DYBIDXAI.COM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
We do not warrant that the Service will be uninterrupted, error-free, or secure. The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
9. Indemnification
You agree to indemnify and hold harmless dyBIdxAI.com from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party, including candidates interviewed through the platform.
10. Dispute Resolution
Informal Resolution: Before filing any formal dispute, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration: If informal resolution fails, any dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall be conducted in English.
Class Action Waiver: You agree that disputes will be resolved on an individual basis and not as part of any class, consolidated, or representative action.
Governing Law: These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
11. Termination
We may suspend or terminate your access at any time for violations of these Terms. Upon termination, your right to use the Service ceases immediately. Sections 5, 6, 8, 9, and 10 survive termination. You may request an export of your data within 30 days of termination.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Service at least 14 days before they take effect. Continued use after changes constitutes acceptance.
